These Terms of Service (“Terms”) govern your access to and use of the website operated by AERTHIN, including all related services, features, and product purchases. By accessing, browsing, or placing an order on this website, you fully accept and agree to be bound by these Terms. 1. User Responsibilities
All users accessing and using the AERTHIN official website shall bear the following legal and operational responsibilities:
1.1 Users shall use the website and related services in compliance with all applicable laws, regulations, and network management rules of the Hong Kong Special Administrative Region and relevant international conventions, and shall not use our platform for any illegal, improper, or unauthorized purposes.
1.2 When registering an account, browsing products, submitting orders, or providing any information on our website, users shall guarantee that all submitted information (including personal information, contact information, payment information, and shipping information) is true, accurate, complete, and up-to-date. Users shall be solely responsible for any losses caused by false, inaccurate, or incomplete information.
1.3 Users shall properly safeguard their account credentials, passwords, and device access permissions. Users are fully responsible for all activities, orders, and operations conducted under their account, whether authorized by the user or caused by user’s negligence in account security management.
1.4 Users shall independently bear the responsibility for their own network equipment, network fees, and equipment maintenance costs required to access and use our website services.
2. Prohibited Conduct
Users are strictly prohibited from engaging in the following behaviors when using the AERTHIN website and services. AERTHIN reserves the right to immediately restrict access, suspend accounts, cancel orders, and pursue legal liabilities for any violation:
2.1 Any illegal behaviors, including but not limited to fraud, money laundering, infringement of third-party rights, and other acts that violate local laws and international trade regulations.
2.2 Malicious attacks, interference, or destruction of the website’s normal operation, including virus transmission, network intrusion, data tampering, server attack, crawler scraping, and unauthorized access to website background data.
2.3 Forging, tampering with, or deleting the website’s content, product information, order data, and copyright identification information; releasing false, misleading, defamatory, obscene, violent, harassing, or illegal information through the platform.
2.4 Unauthorized commercial use, including reselling, replicating, or distributing AERTHIN’s products, pictures, texts, and service resources without official authorization.
2.5 Abusing platform preferential policies, malicious order brushing, malicious refund applications, collusion with third parties to defraud benefits, and other improper profit-seeking behaviors.
2.6 Any other behaviors that damage the legitimate rights and interests of AERTHIN and third parties or hinder the normal operation of the platform.
3. Intellectual Property Rights
3.1 All intellectual property rights on the AERTHIN website are exclusively owned by AERTHIN, including but not limited to trademarks, logos, brand names, text content, pictures, videos, graphic designs, website layout, code, product design drawings, and all original content of the platform.
3.2 All intellectual property rights of the website content are protected by trademark law, copyright law, and international intellectual property protection conventions. Without the written official authorization of AERTHIN, no user or third party may copy, reproduce, modify, disseminate, publish, commercialize, or use the above content in any form.
3.3 Users shall not use AERTHIN’s trademarks, logos, and brand elements in any misleading, infringing, or defamatory manner. Any unauthorized use of our intellectual property constitutes an infringement, and AERTHIN reserves the right to pursue all legal liabilities including compensation for losses.
3.4 Users confirm that all content they actively upload, comment, or submit on the website does not infringe any third-party intellectual property rights. Users shall bear full responsibility for any infringement disputes arising from user-submitted content, and shall compensate AERTHIN for all resulting losses and legal costs.
4. Payment Rules
4.1 All product prices displayed on the AERTHIN website are subject to the real-time pricing on the platform. All prices do not include logistics fees, tariffs, and other additional expenses unless otherwise specified. Users shall bear the relevant additional costs incurred during cross-border transactions.
4.2 Users shall complete payment through the official payment channels designated by our website. AERTHIN does not accept any offline private transfer or unofficial payment methods. Any losses caused by users’ private transactions shall be borne by users themselves.
4.3 Once the user successfully submits and pays for the order, it means the user confirms the product model, quantity, price, and service content of the order. AERTHIN reserves the right to cancel unconfirmed, abnormal, or suspicious risky orders.
4.4 For refund and return applications, users shall comply with the platform’s official after-sales policy. Refunds will be returned through the original payment channel within the specified working days after the application is reviewed and approved. AERTHIN does not bear the handling fees charged by third-party payment institutions.
4.5 If the order cannot be normally delivered or fulfilled due to user reasons (including wrong shipping address, unreachable contact information, user-initiated order cancellation after delivery arrangement), AERTHIN has the right to deduct the actual logistics cost and loss cost from the refund amount.
5. Disclaimer & Limitation of Liability
5.1 The AERTHIN website and its services are provided on an “as is” and “as available” basis. AERTHIN makes no express or implied warranties, including but not limited to the continuity, accuracy, completeness, stability, and error-free nature of website services and product information.
5.2 To the fullest extent permitted by applicable law, AERTHIN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to profit loss, data loss, business interruption loss, and reputation loss, arising from users’ use or inability to use our services.
5.3 AERTHIN does not assume liability for service interruptions or data errors caused by force majeure (including natural disasters, wars, policy adjustments, epidemic control), third-party network failures, third-party payment system failures, and other uncontrollable external factors.
5.4 AERTHIN is not responsible for any losses caused by users’ improper operation, unauthorized modification of website data, violation of these Terms, or failure to comply with relevant laws and regulations.
5.5 Some jurisdictions do not allow the limitation of liability for consequential damages, so part of the above liability limitations may not apply to individual users, which shall not affect the validity of other clauses.
6. Dispute Resolution
6.1 These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, excluding its conflict of law rules.
6.2 In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the use of our services, the parties shall first resolve the dispute through friendly negotiation.
6.3 If the negotiation fails, both parties agree to submit the dispute to the competent court of the Hong Kong Special Administrative Region for exclusive resolution.
6.4 Any dispute resolution shall be conducted in accordance with the latest valid version of these Terms, and the final interpretation right belongs to AERTHIN.
7. Effective Date & Amendment
Effective Date: May 12, 2026
7.1 These Terms of Service shall take effect on the above effective date and shall apply to all users who access and use the website after the effective date.
7.2 AERTHIN reserves the right to update and revise these Terms at any time according to business adjustments and legal requirements. The revised Terms will be published on the official website and take effect immediately upon publication. Continued use of the website by users after the update constitutes acceptance of the revised Terms.
7.3 If any clause of these Terms is deemed invalid or unenforceable due to legal adjustments, the validity of the remaining clauses shall not be affected.
